IF YOU DO NOT AGREE WITH OR ACCEPT ALL OF THESE TERMS AND CONDITIONS, YOU MUST IMMEDIATELY STOP USING THE SERVICES, TELEGRAM GROUP, AND ANY RELATED WEBSITES.

YOUR ENTRY AND CONTINUED USE OF THE SERVICES, TELEGRAM GROUP, OR ANY ASSOCIATED WEBSITES CONSTITUTES YOUR AGREEMENT TO THESE TERMS AND ANY FUTURE REVISIONS.

• DEFINITIONS 

1. Service Provider – service provider of the Telegram Group is ARN TRD MARKETING MANAGEMENT L.L.C operating under License Number: 1382370, Register Number: 2409455 based in Dubai, United Arab Emirates, moderating person operating on Telegram under the nickname __________. All notifications shall be directed to the Service Provider via dedicated tools within the Telegram application.

1. Agreement – shall mean these Terms and Conditions. 

1. Telegram Group – Telegram group available under the name „Wskaźniki Lucasa”, or its translation into a different language, under the Telegram terms of service (https://telegram.org/tos). Access to the Telegram Group is paid. Telegram Group access fees are incurred by the User and may be automatically renewed until the User resigns. The User hereby authorizes the Service Provider to charge for the next billing period in accordance with these Terms and Conditions.

1. User – A natural person, a legal person, an organizational unit without legal personality to whom the law assigns legal capacity, who manages business or acts professionally, or has appropriate competences on the basis of national law to participate in the Telegram Group, if applicable in the place of temporary or permanent residence and who uses the Services on the Telegram Group.

1. Provider – External entities, that provide or may provide services and content on the Telegram Group.

1. Crypto Assets – cryptocurrencies in the general meaning as a digital representation of value within the framework of relations between participants in the blockchain technology network or a particular cryptocurrency exchange. 

1. Service / Services – use of the Telegram Group provided by the Service Provider and related services.

1. Intellectual Property Rights – means all and any data, information, video, graphics, sound, music, photographs, software, any other materials or content (in whatever format), copyrights as well as all computer code or scripts, whether compiled or not in any computer language or program, all patents, utility models, trademarks, know-how, trade names, domain names, rights in logo and get-up, inventions, all rights in computer software and data, databases, confidential information, trade secrets design rights (whether registered or unregistered) and semiconductor topographies and all intangible rights, privileges and forms of protection of a nature or having a similar effect to any of the above which may subsist anywhere in the world.

1. Restricted Content – means any content or term that: (i) promotes or is related to illegal activities (illegal drugs, phishing, terrorism, criminal activities, contests, pyramid schemes or chain letters etc.); (ii) promotes or is related to tobacco, gambling or weapons; (iii) is related to pornographic or obscene material; (iv) is related to excessively graphic or explicit violence; (v) is defamatory, inappropriate or profane; (vi) is discriminatory or constitutes “hate speech”, whether directed at an individual or a group, and whether based upon the race, sex, creed, national origin, religious affiliation, sexual orientation or language of such individual or group; (vii) promotes or contains viruses, worms, corrupted files, cracks or other materials that are intended to or may damage or render inoperable software, hardware or security measures of the Service Provider, any User, or any other third party. 

• GENERAL PROVISIONS

1. The User acknowledges and accepts that the Service Provider manages Telegram Group under the name: “Wskaźniki Lucasa” (hereinafter referred to as the „Telegram Group”). The User establishes a relationship with the Service Provider through third-party services (in particular but not limited to https://telegram.org). By using the Telegram Group, you also agree to comply with the Telegram terms of service available at: https://telegram.org/tos and the Telegram FAQ available at: https://telegram.org/faq. 

1. The User fully accepts the provisions of this document without any reservations or additions and acknowledges that: (i) the Service Provider’s activities do not constitute a public offer, alternative investment fund management, or activities conducted by an investment fund; (ii) the Service Provider is not engaged in banking, insurance, or reinsurance activities as defined by the relevant national laws governing the location of the Service Provider’s headquarters; (iii) the Service Provider does not guarantee that participation in the Telegram Group, use of the Service, or the purchase of any specific Crypto Assets will lead to expected outcomes, financial results, or profits; (iv) the User should never invest more than they can afford to lose, and must be prepared to lose all invested funds. If the User has doubts about purchasing any particular Crypto Asset, independent legal, tax, or financial advice should be sought before proceeding.

1. You explicitly acknowledge that owning, purchasing, or possessing Crypto Assets does not confer any rights or claims against the Service Provider. Crypto Assets are not financial or investment instruments of any kind, may not have any real-world monetary value, and the Service Provider is not responsible for any attributed value, fluctuations, or loss in value of Crypto Assets.

1. The User acknowledges and agrees that the Service Provider manages the Telegram Group and that any purchase of Crypto Assets establishes a relationship based on different terms or conditions, depending on the type of Crypto Asset purchased. Therefore, the purchase of Crypto Assets does not constitute a transaction or agreement directly with the Service Provider.

1. Any information provided by the Service Provider does not constitute an offer within the meaning of applicable laws and is not a proposal for such an offer. It is for informational purposes only.

1. Each User is obligated to comply with the provisions of this document when using the Telegram Group or related information. The User must read and understand the terms herein. While accepting these terms is voluntary, it is a prerequisite for using the Telegram Group. Documents intended for Users are available electronically on the Telegram Group, allowing Users to store and retrieve them in the course of regular activities.

1. Headings are included for organizational purposes only and are meant to assist in the interpretation of this document. References to documents include the relevant document and any subsequent amendments unless explicitly stated otherwise. Unless the context dictates otherwise: (i) words referring to a category apply to all forms of that category; (ii) singular terms apply to plurals and vice versa; (iii) capitalized terms are defined in Section (II) of this document. The contents of documents made available on the Telegram Group will inform the interpretation of this document, and these documents are treated as mutually explanatory..

• RESTRICTIONS 

1. Our Services are designed for adults, and we do not knowingly collect, nor do we wish to collect, any information about children. Persons under the age of 18 (in words: eighteen) are strictly prohibited from using the Service. The Service Provider will deny access to the Service for individuals under the age of 18 (in words: eighteen). The User is fully responsible for any unauthorized use of the Service by minors, including the use of online payment systems through tools provided by Telegram (https://telegram.org/) or Providers.

1. Use of the Services may be subject to territorial restrictions. The Service Provider grants access to the Services in compliance with local laws and reserves the right to choose, limit, or refuse service in any specific jurisdiction at any time.

1. Users are required to use the Telegram Group in accordance with applicable laws, the Telegram terms of service (https://telegram.org/tos), this document, third-party website regulations, and general social norms. This includes adherence to the general principles of Internet usage and website conduct, while respecting the rights of third parties, Providers, and the Service Provider. Specifically, the User must not use the Telegram Group in a way that interferes with its proper functioning, causes inconvenience to other Users, Telegram, or the Service Provider, or disrespects the personal rights of others (including the right to privacy). Additionally, Users must use any information and materials shared via the Telegram Group within the bounds of fair use and applicable licenses.

1. The following actions are strictly prohibited: (i) joining the Telegram Group using false information, a false identity, or on behalf of another person; (ii) sharing, buying, selling, renting, or transferring access to the Telegram Group; (iii) using the Telegram Group for commercial purposes, including advertising, solicitation, or sending commercial messages, such as spam or repetitive or misleading communications, to anyone.

• ACCESS AND USE OF THE TELEGRAM GROUP

1. Telegram Access. The Telegram Group is accessible to users with devices that have an Internet connection and an active Telegram account. To utilize the Telegram Group, the User must correctly enter the website address and access it on a device compatible with the Telegram application. Services offered within the Telegram Group are provided at the User’s request and are governed by Telegram’s terms of service (https://telegram.org/tos). While the Service Provider strives to ensure continuous access to the Telegram Group, it reserves the right to suspend, limit, or remove access at any time without prior notice. The User acknowledges that they have no claims against the Service Provider in such cases.

1. Consequences of Violations. If the User engages in activities that are prohibited by law or these terms, or acts contrary to social norms or the legitimate interests of the Service Provider and/or Telegram, the Service Provider may take all legally permissible actions, which may include limiting or preventing the User’s access to the Telegram Group.

1. Termination of Access. Without prejudice to other remedies available to the Service Provider, if it determines that the User is in violation of this Agreement or any applicable laws, it may, at its discretion, limit, suspend, terminate, modify, or delete the User’s access to the Telegram Group or any part thereof. The Service Provider is not obligated to compensate the User for any loss of access to the Telegram Group or related benefits resulting from such actions. The Service Provider may also take additional technical and legal measures to restrict access for Users who violate this Agreement or applicable laws. This includes actions that protect the Service Provider, Telegram, or its affiliates from potential legal claims arising from violations of laws or third-party rights, including, but not limited to, Intellectual Property Rights. The Service Provider reserves the right to cease offering the Telegram Group at any time for any reason, resulting in an immediate termination of the User’s license. The Service Provider is not responsible for compensating the User for any loss of benefits, privileges, or funds resulting from the discontinuation of the Service. The Service Provider will determine what constitutes a violation of this Agreement and will take appropriate actions, including barring the User from using the Telegram Group, as permitted by law.

1. Technical Breaks. Technical issues may disrupt the functioning of the Telegram Group. The User has no claims arising from the suspension or termination of service by the Service Provider or Telegram. Service provision may be interrupted due to poor connection quality, damage or defects in telecommunications equipment, power outages, failures in the telecommunications network, or actions by third parties.

1. External Services and Content. The Service Provider may collaborate with third-party Providers to offer additional services and content within the Telegram Group. The terms and conditions governing these electronic services are detailed in the regulations of the respective websites. To utilize additional services and content, Users must read and accept the relevant terms and conditions. In case of any conflict between these terms and the terms governing additional services, the latter shall prevail. For matters not covered by individual website provisions, the terms here shall apply.

1. Changes to the Service. The User acknowledges that the Service Provider may, at its sole discretion, change access to the Telegram Group during the User’s access period, including switching access to another group (e.g., on a different platform or similar access). The User will retain access to the Telegram Group until it is terminated; thereafter, access will be granted to another similar group. The Service Provider also reserves the right to transfer access to the Telegram Group to another third-party website or platform, ensuring the User can continue to access the Telegram Group. The User has no claims against the Service Provider due to such changes.

• CHANGES IN THE SERVICE, WARRANTIES AND OWNERSHIP

1. Change of Group Name. If the majority of Users are from a specific country, the Service Provider may change the group name to a translation of „Wskaźniki Lucasa” in that country’s official language. The Service Provider may change the group name at any time at its discretion. Should the name be changed, it will be reflected in this Agreement and other relevant documents.

1. No Warranties. The Service Provider does not guarantee that its Services will be accessible to the User at their chosen times or locations, nor does it ensure that the Services are error-free or free from viruses or harmful components. Additionally, the Service Provider does not warrant that access to the Telegram Group will meet the User’s specific requirements.

1. Ownership Rights. The Service Provider or its Providers own all rights, title, and interest, including, but not limited to, all Intellectual Property Rights or proprietary rights related to the information provided within the Telegram Group. Except as explicitly stated in these Terms of Use, no part of any Intellectual Property Rights owned by the Service Provider or its Providers may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose without the prior written consent of the Service Provider or Provider

1. Updates. To ensure the proper operation of the Service, the Service Provider reserves the right to update the Service at its discretion without prior notice. Continued use of the Services constitutes acceptance of these updates, including any updates to third-party software from time to time.

• PURCHASE OF ACCESS TO TELEGRAM GROUP

1. Value. The User acknowledges that the purchase of access to the Telegram Group is provided by the Service Provider or by Providers within the tools available on Telegram or within the third-party websites to which the Telegram Group redirects. The relevant unit and value for the purchase is determined in each case by the Service Provider or Provider or the websites of those third parties (e.g., the specific payment operator) which allow the purchase of access to the Telegram Group.

1. Automatic payments. The Service Provider or the Provider shall, upon the express request of the User, make available the possibility of making recurring payments for access to the Telegram Group. The terms of activation shall be determined in each case by the respective payment operator (Provider).

1. Delivery time. Access to the Telegram Group shall take place immediately, with the possibility of extending this period up to 7 (in words: seven) days in the event of force majeure. Delivery is by electronic means only. 

1. Returns. Due to the close relationship to financial markets over which the Service Provider has no control, and due to the electronic delivery of the Telegram Group access to the User, the User acknowledges and agrees that the Service Provider does not accept any returns by law. The User acknowledges and accepts that all transactions related to the purchase of each access to the Telegram Group are final and it is not possible to return. 

• PROVISIONS RELATING TO CRYPTO ASSETS

1.  Transactions on Crypto Assets. The User can purchase Crypto Assets, which are digital representations of value generated on the blockchain network, through third-party websites, including cryptocurrency exchanges, at their own discretion. The Service Provider has no involvement with the Crypto Assets, and the User independently decides whether to purchase specific Crypto Assets from third parties utilizing blockchain technology. All transactions on blockchain networks require a transaction fee, commonly known as a „Gas Fee.” The User acknowledges and agrees that all transactions conducted via blockchain technology are final and irreversible.

1. No Claims. The Service Provider is not liable to the User or any third party for any claims or damages that may result from transactions conducted by the User via blockchain networks or through the cryptocurrency exchanges where the User holds accounts.

1. Taxes. The User is solely responsible for paying any and all applicable sales, use, value-added, and other taxes, duties, and assessments (excluding taxes on the Service Provider’s net income) that may now or in the future be claimed or imposed by any governmental authority concerning Crypto Assets.

1. Fees and Price. The price of Crypto Assets in secondary markets may fluctuate based on various factors, including the methods and locations from which the User acquires them. The price and availability of Crypto Assets on secondary markets are subject to change. The User expressly acknowledges and agrees that their participation in the Service and their receipt and possession of any Crypto Assets are voluntary and intended solely for entertainment purposes.

1. Risk assumptions. User accept all risks that arise from using the Service and Crypto Assets, including but not limited the risk of loss of any funds in your possession. Your Crypto Assets may be lost, stolen, or otherwise rendered unusable. In any of the above cases, you do not have a claim to the Service Provider, including for the return of any funds. You accept and acknowledge each of the following:

1. The prices of blockchain assets are extremely volatile. Fluctuations in the price of other digital assets could materially and adversely affect the value of your Crypto Assets, which may also be subject to significant price volatility. We cannot guarantee that any purchasers of Crypto Assets will not lose money.
2. The Service Provider does not store, send, or receive Crypto Assets. 
3. User acknowledges and understands that there are risks associated with using an Crypto Assets, including, but not limited to, the risk of hardware, software and Internet connections, the risk of malicious software introduction, and the risk that third parties may obtain unauthorized access to information stored within your wallet. User accepts and acknowledges that the Service Provider will not be responsible for any communication failures, disruptions, errors, distortions or delays you may experience when using the blockchain network or a third-party cryptocurrency exchange. 
4. The Service Provider neither owns nor controls any third party site, product, or service that you might access, visit, or use for the purpose of enabling you to use the various features of the Service. The Service Provider shall not be liable for the acts or omissions of any such third parties, nor shall be liable for any damage that User may suffer as a result of User’s transactions or any other interaction with any such third parties.

1. Safety. Each User undertakes to use the Service in accordance with its purpose, applicable law, social and moral norms and the provisions hereof. The User is obliged to protect own passwords, logins and private keys against third parties access. Any results of unauthorized acquisition of the password, keys or other data enabling the access to the Crypto Assets owned by the User are not the liability of the Service Provider. 

• COPYRIGHTS AND INTELLECTUAL PROPERTY 

1. Upon use of the Telegram Group and the acceptance hereof by the User, the Service Provider grants the User a non-exclusive license to use the Telegram Group, to the extent of the Services used by the User. The license is non-transferable and is granted for the duration of the User’s use of the Telegram Group in accordance with its purpose and in a manner consistent herewith. The non-exclusive license granted to the User does not authorize the User to grant further licenses. Furthermore, the User is not authorized to act outside the scope of the License.

1. The User has no right to reproduce, sell or otherwise market or distribute the content provided on the Telegram Group, in whole or in part, in particular to send or make it available in computer systems and networks, mobile application distribution systems or any other IT systems. 

1. Along with the termination of the Agreement, the granted licenses are terminated with a 7-day notice period. For the use of the work after this period, the Service Provider shall be entitled to charge additional remuneration. 

1. In the event of a breach by the User of the terms and conditions of use of the Telegram Group or the granted licenses, the Service Provider shall be entitled to block the User’s access to the Telegram Group and revoke the granted license. The above does not prejudice the Service Provider’s right to take other appropriate and legal actions in connection with the breach.

• NOTIFICATIONS AND COMPLAINTS 

1. All notifications shall be directed to the Service Provider via dedicated tools within the Telegram app to the person in charge of the Group in the name of Service Provider, which currently is ___________.

1. Content of the Notification. The notification shall include: User details, contact details, reasons for notification and detailed description.

1. Response to the Notification. Within 14 days from the date of receiving a notification, the Service Provider considers the notification and informs the User about the result of its consideration. This period may be extended if the consideration of the complaint requires special information or the Service Provider encounters other difficulties beyond its control or if it is necessary to obtain additional information from the User. The reply to the complaint shall be sent by the Service Provider via Telegram app in response to the notification or by e-mail. Sending a complaint by the User in an electronic form is understood as a consent to receive a response from the Service Provider also in electronic form.

1. Reservations. The Service Provider reserves the right not to respond to a complaint that is clearly unfounded, in particular to the extent that the complaint has already been examined in relation to a given User. 

• LIABILITY OF THE SERVICE PROVIDER

1. The Service Provider publishes information on the Telegram Group on an ongoing basis, ensuring its correct operation. However, the Service Provider does not guarantee the constant availability of the information published on the Telegram Group, as well as their error-free operation. 

1. Exemption of Liability. The User uses the Services voluntarily, at own risk. As far as it is permitted by law, the Service Provider is not liable to the User for any damages, including loss of revenues, lost profits, data, business interruption or other unless these damages arise from the Service Provider’s gross negligence or willful misconduct or from death or personal injury arising from Service Provider’s any negligence or fraud. These Terms and Conditions does not affect any statutory rights of consumers. The User undertakes to indemnify, defend and hold the Service Provider (and its officers, directors, agents, subsidiaries, joint ventures and employees) harmless from any claim, demand, damages or other losses, including reasonable attorneys’ fees, asserted by any third party resulting from or arising out of the User’s use of the Service, or any breach by the User of this Agreement. For the avoidance of doubt, the foregoing does not apply if the infringement of rights is not attributable to the User’s intentional or negligent behavior.

1. Force Majeure. The Service Provider shall not be liable and shall be excluded from performing if such performance hereunder is interfered with by any condition beyond the Service Provider’s reasonable control, including labor disputes, or other industrial disturbances, electrical or power outages, utilities or other telecommunications failures, earthquake, storms or other elements of nature, blockages, embargoes, riots, acts of orders of government, acts of terrorism or war.

• FINAL PROVISIONS

1. Disputes. All disputes that may arise in connection herewith shall be settled amicably in the first place, by mutual arrangements between the User and the Service Provider. The User acknowledges and accepts that the amicable resolution of a dispute procedure is a condition precedent that shall be met prior to commencing any legal proceedings. In such a situation, the User is obliged to contact the Service Provider via Telegram pursuant to provisions hereof. If the above requirements are met, as well as in the absence of an amicable solution to the dispute, the provisions hereof shall be settled by the court competent for the current place of the registered office of the Service Provider. At the same time, the User acknowledges and accepts that disputes arising therefrom may only be considered on the basis of an individual case of the User. In no way the Service Provider is obliged to settle disputes as collective cases or collective actions.  

1. Relevant Jurisdiction. The provisions hereof and all disputes between the Service Provider and the User are subject to law applicable in the place of the Service Provider’s registered office at a given moment, unless the law in your country of residence allows you to choose the courts of that country for the dispute in question. 

1. Right to transfer. The User acknowledges and accepts that, the Service Provider may transfer the rights and obligations resulting from the implementation of the provisions hereof to another entity, person or third parties, including transferring the rights and obligations to another, newly established company as a result of the transformation.   

1. Additional Policies. The Service Provider may publish additional policies related to the Telegram Group. The User must agree and comply with these policies to use the Telegram Group. 

1. Nullity. No legal basis or incompleteness of any of the provisions contained herein does not mean that the entire document is null and void. Such provisions shall be amended to the ones that best reflect their meaning and purpose.

Right to change. The Service Provider reserves the right to make changes to this Agreement, if necessary, in particular for legal reasons or in connection with changes in the services provided. In the event of such a circumstance, the User shall be informed and the Service Provider shall publish the current wording of the Agreement on the Telegram Group.
